1. Scope and Acceptance
Welcome to Cozumel Reefs Maps. By accessing, registering, or using our website, services, or platforms, and by providing personal data or making payments (including via Stripe or blockchain tokens using MetaMask), you agree to these Terms and Conditions and this Privacy Policy.
The Company provides digital services through web-based platforms, including subscription-based tools, interactive 3D reef visualization, dive route planning, depth estimation, and related online services.
2. Users and Eligibility
The Site is intended for individuals of legal age who are capable of entering into binding contracts. Minors may use the services only with the authorization and supervision of a parent or legal guardian.
3. Registration, Access and Account Security
Certain services require account registration. Users are responsible for maintaining accurate and up-to-date information and for all activities carried out under their account.
Authentication credentials are protected using secure hashing and encryption mechanisms. Passwords are never stored in plain text and are not accessible to the Company.
4. Service Availability and Maintenance
The Client acknowledges that web servers, hosting infrastructure, and digital services may experience temporary interruptions, scheduled maintenance periods, upgrades, or technical intermittencies inherent to online platforms.
In such cases, service availability may be partially or temporarily suspended without constituting a breach, provided reasonable efforts are made to restore normal operation.
The platform is provided “as is” and uninterrupted or error-free operation cannot be guaranteed at all times.
5. Service Suspension, Closure, and User Guarantee
In the event that the service becomes unusable due to prolonged technical issues, extended maintenance, or if the Company permanently ceases operations, end users shall be protected by a downloadable archive containing all content, data, and services generated by the platform.
This guarantee shall become effective once:
- the Company formally confirms permanent service closure, or
- the service remains unusable for a continuous period exceeding sixty (60) days.
This mechanism ensures that clients retain access to the value generated by the service and provides a reliable, transparent, and viable long-term guarantee.
6. Infrastructure Changes and Data Continuity
In the event of changes to server infrastructure, hosting providers, or domain names, the Company shall provide prior notice through its website with a minimum of ten (10) days’ advance notice.
During such transitions, databases required for user authentication and service usage shall remain available to ensure continuity where technically feasible.
7. Payments, Subscriptions and Billing
Payments may be processed via Stripe (credit/debit cards) or through blockchain-based token payments using MetaMask (ERC-20 standard on Ethereum).
Credit and debit card information is processed securely by Stripe. The Company does not store full card details.
Blockchain transactions are final and non-reversible once confirmed. Rejected, unpaid, or disputed payments may result in suspension or termination of service access.
Subscription payments are non-refundable for periods already consumed, unless otherwise required by applicable law.
8. Data Security, Encryption and Privacy
All data storage and communications are protected using industry-standard encryption mechanisms.
The Company does not have access to sensitive user data such as passwords, private communications, or payment credentials.
The Company’s operational access is strictly limited to:
- user name,
- unique user identifier,
- registration dates, and
- records of payments made.
Email addresses and identifiers may exist in encrypted form for authentication, billing, and service communication purposes, but are not readable in plain text.
9. Permitted Use and Liability
Users agree not to misuse the platform, engage in illegal activities, infringe third-party rights, or attempt to extract, scrape, or reproduce content without authorization.
Reef data, depth simulations, and route planning tools are provided for reference purposes only and may not be 100% accurate. They must be used with appropriate caution.
The Company shall not be liable for indirect, incidental, or consequential damages, except where such limitation is not permitted by law.
11. Commissions, Settlement and Invoicing
Where applicable, commissions for promotion, referral, or partnership services shall be paid based on the percentage agreed in writing between the parties.
Unless expressly stated otherwise, all commission amounts shall be understood as VAT included, and represent the total amount payable.
Commission calculations shall be based exclusively on income effectively collected by the Company.
Commission settlements shall be calculated on a monthly basis, with a fixed cut-off date on the 26th day of each month, covering the applicable settlement period.
Payment of commissions shall be made only upon receipt of a valid CFDI invoice, duly issued in accordance with Mexican tax regulations and clearly itemising the taxable base and VAT.
Commission payments shall be made via bank transfer within a reasonable period following receipt and validation of the corresponding invoice.
12. Final User Invoicing Requests
If the final user requires a tax invoice for the services purchased, the request must be submitted directly by email to: admin@cozumel-reef-maps.com.mx.
Invoice requests must be made within a maximum period of five (5) business days following the date of payment.
Requests submitted after this period may not be processed, in accordance with applicable tax and administrative regulations.
13. Trust, Modifications and Governing Law
The Company affirms that its services are supported by a transparent, enforceable, and technically viable framework, designed to protect clients, partners, and end users.
These Terms may be updated periodically. Continued use of the Site implies acceptance of the updated version.
These Terms are governed by the laws of Mexico. Any disputes shall be submitted to the competent courts of Quintana Roo, Mexico.
